161208 Sixth Trial of Defendant A & Her Accomplices on Charges of False Accusation and Attempted Extortion
1. Date and Time
Dec. 08, 2016, 4 PM
Note 1: The trial started at the scheduled time at 4:00 pm (more exactly 3:58 PM).
2. Judicial Bench
Seoul Central District Criminal Court 15 Single Judge Choi Jong Jin
3. Defendants
1) Lee, so-called A, charged with false accusation & attempted extortion, imprisoned
2) Hwang (mob) charged with attempted extortion, imprisoned
3) Lee (Defendant Lee’s boy friend) charged with attempted extortion, not imprisoned
Note 2: This case is the case of false accusation and attempted extortion. The above three people stand the trial as the defendants. Many of Korean newspapers still mislead the information on the relationships among the three defendants. Many of them still report Defendant Hwang is Defendant Lee (A)’s cousin, but it is NOT true. Mob Hwang was introduced to the other two defendants to plan and execute their crime when they premeditated it (Refer to this posting by 6002Sky https://goo.gl/7rFudU).
Note 3: Mob Hwang was indicted for two other fraud cases. Thus, all three cases were consolidated together and he has been tried for three cases at the same court. Under the Korean Criminal Procedure Act, Article 300, the court may order the consolidation of oral proceedings (i.e., trial cases) upon request of a prosecutor or defense counsel or ex officio to reduce repetitive procedures.
Note 4: Defendant Lee submitted the letter of apology twice on the 6th and on the 8th. Defendant Hwang submitted the letter of apology on the 7th.
4. The Testimony of the Witnesses
Two witnesses testified at the 6th trial. The witness testimony was held in the closed court for the protection of the privacy of the victim, Yuchun.
Note: 5 The first witness (called by the Prosecutors) testified from 4:03 to 4:22 PM.
Note: 6 The second witness (called by the Defense Counsel) testified from 4:22 to 4:56 PM. This second witness was the policeman who was present at the time when Defendant Lee withdrew her report. The CD taped at that time was replayed at the court and submitted as evidence.
5. The End of the 6th Trial
The trial ended at 4:57 PM. The 7th trial will be on the 22nd of Dec.
Note 7: On this trial day, few members of the feminist organization who have supported the defendants attended the court. One person from this organization put her hand on the Defendant Lee (A)’s shoulder and tried to talk to her. The court service officer restrained that person and told her it wasn’t allowed to talk to the Defendants.
Note 8: There were three news reports on this 6th trial.

As the list above is showing, two news reports were posted before the trial time and the reporters from these two newspapers didn’t attend the court. The reporter from Herald POP was the ONLY one who came to the court for the 6th trial.

I say RELEASE THE APOLOGY LETTERS PUBLICLY! They bullied Yoochun publicly and got every space for doing that, why not listen to them now? At least these self-proclaimed feminists would have to rethink their stance and who they root for. As far as I know feminism wants to teach people women are equally capable and worthy as men, not that women can harm men without punishment?! These women are hardly feminists, it’s more likely they’re bullies who hate men or maybe they hate Yoochun specifically. What else would make them support defendant A whose identity was not disclosed? They’re not supposed to know anything about this woman except for her gender and that she’s a proven liar. If that’s enough for them to become her fans, shame on them. (Or maybe they know def A and wanted to talk to her on this occasion, so they pretended to be unrelated supporters??)

It’s horrifying that this species of fake feminists seems to be on the rise all over the world. They disguise themselves as fighters for equality but they’re only equally bad as the worst of men. Hateful and reckless.

Some may ask: Why did the Woman submit her letter of apology twice?
Most probable answer is: Because she’s charged with two crimes (as stated above).
Firstly, for false accusation of sexual assault & secondly, for attempted extortion.
What does their submission of the letters of apology mean?
It means;
The Woman (Lee, so-called A), OFFICIALLY APOLOGISED & ADMITTED to the court for committing BOTH the crimes charged on her.
Hwang (mob), OFFICIALLY APOLOGISED & ADMITTED to the court for the crime charged on him.
Meaning? Both are GUILTY of the crimes charged on them.
In layman’s term;
The Woman (Lee, so-called A) officially apologise & admitted to the court
for FAKING sexual assault (=no sexual assault took place) in her attempt to EXTORT money from Yoochun.
She is the one who’s guilty of committing crimes, NOT Yoochun.

I am not sure whether she submitted her apology letters for her 2 different crimes separately or not. And, she may have to submit the apology letters because that’s the only remaining option for her to have lighter sentencing. But, there is no guarantee that any apology letter would lessen the sentencing. It will depend on how well a defendant can show his/her repentance, which I personally doubt in this case (my personal opinion). To submit the apology letters meant they admitted their crimes AS A RESULT. I don’t think it’s the same as she made an apology at court. We don’t know what has been going on in the court because the trials have been closed. Considering the stance of the defendant to keep claiming her as the victim of this case, I don’t think last minute apology letters deliver a glimpse of her sincere repentance.

Yup, most likely.
It is a norm for criminals to submit their letters of apology to the court as their last resort.
When they (or rather their lawyers) know there's no way for them to defend themselves any further;
when they (or rather their lawyers) know that there's no other way out;
when everything else fails;
the only option left is to submit letters of apology, to beg mercy from the court.
Like you said, I guess it's safe to assume that they are not submitting the letters of apology because they feel any remorse.
Only humans can feel remorse. Sorry, in my book, they are not fit to be called humans.
So the only reason left as to why they've submitted their letters of apology to court
is OBVIOUSLY to plead for lighter sentencing from the court. Shame on them.

Here is why I am currently supporting Yoochun. Please note…I am no kid. I have been around the world and back, and I’m and probably two or three times older than most of the posters here, so I do have a lot of life experience with people of various cultures/roles in life. Looking at this logically without emotion of a young fan, here is what I believe right now:
1. I believe in innocent until proven guilty.
2. As a previous poster mentioned, there has been nothing in his past that would lead one to believe that he would commit such crimes.
3. I believe that he would never do anything that would bring shame on or destroy the relationship of his JYJ members or agency.
4. I believe that he would never do anything that would bring shame or dishonor to his beloved mother.
5. I believe that he would never do anything that would bring shame, dishonor or reflect upon his brother’s life and career.
6. I believe that the media has taken it too far, reporting half-truths and mis-truths in order to sell their publications.
7. I believe that there are many, many people out there who live to bring celebrities down out of envy.
I believe unfortunately, that even if found not guilty for all charges by all people, there will still be too many netizens who will continue to spread
hate and say he “bought” his freedom. To those writing malicious stories, media and netizens, I ask if you are proud of destroying lives? Not just Yoochun’s life is affected by this, but also his mother’s, brothers, JaeJoong, Junsu and the many, many people that work for them directly and the agency. Would you want this to happen to your family? Don’t think it can? Think twice. All it would take is someone who doesn’t like you to take you down…and fast. Do unto others as you would have them do unto you.
