161201 Fifth Trial of Defendant A & Her Accomplices on Charges of False Accusation and Attempted Extortion

Dec. 01, 2016, 4 PM
Note 1: The trial was scheduled to start at 4:00 pm, but due to the delay of the previous trial assigned for the same courtroom, it started around 4:10 PM.

3. Defendants
1) Lee, so-called A, charged with false accusation & attempted extortion, imprisoned
2) Hwang (mob) charged with attempted extortion, imprisoned
3) Lee (Defendant Lee’s boy friend) charged with attempted extortion, not imprisoned
Note 2: This case is the case of false accusation and attempted extortion. The above three people stand the trial as the defendants. Many of Korean newspapers still mislead the information on the relationships among the three defendants. Many of them still report Defendant Hwang is Defendant Lee (A)’s cousin, but it is NOT true. Mob Hwang was introduced to the other two defendants to plan and execute their crime when they premeditated it (Refer to this posting by 6002Sky https://goo.gl/7rFudU).
Note 3: Mob Hwang was indicted for two other fraud cases. Thus, all three cases were consolidated together and he has been tried for three cases at the same court. Under the Korean Criminal Procedure Act, Article 300, the court may order the consolidation of oral proceedings (i.e., trial cases) upon request of a prosecutor or defense counsel or ex officio to reduce repetitive procedures.
4. The Testimony of the Witnesses
Two witnesses testified at the 5th trial. The witness testimony was held at the closed court for the protection of the victim, Yuchun. The first witness was C-JeS CEO, Baek Chang Joo. His testimony ended around 5:30 PM. The second witness was Baek’s father. He entered the court at 5:30 PM and came out of it 6:26 PM.
5. The End of the 5th Trial
After the testimony by these two witnesses, the Judge discussed with the Defense Counsel and the Prosecutors about accepting the submitted material as the evidences. The trial ended at 6:40 PM. The next trial date is the 8th of Dec.
Note 4: Different from the 4th trial, not many reporters appeared in the court for their coverage of this case. 9 reports came out from 7 newspapers. Ilgan Sports and News 1 posted 2 reports each.
Note 5: The fence has been set up outside of the court door to prevent approaching for eavesdropping since the 3rd trial and it was there on the 5th trial day as well. However, a tremendously absurd incidence happened during the trial and many Korean fans witnessed it. Around 5 PM when the testimony by the first witness has proceeded, a female reporter with long hair and grey winter jumper stole the moment of the absence of the court staffs and entered into the fence area. Although the fans pointed out her behavior, she didn’t move insisting that she was checking the notice put on the wall just beside the court door. After a court staff told her to move, she reluctantly came back to the area beyond the fence line. Such attitude of this reporter was another example of an unscrupulous behavior of the Korean reporters which we have been witnessing since the day one of this case. They have no intention to protect the victim of a vicious crime. They only pursue the number of clicks and the resulting compensation from it. If there had been no fans, what would she have done? She may have done the same thing as two reporters sticking to the court door and eavesdropping on the 2nd trial day when there had been no fence.

My goodness, how can a person not have a gram of shame? I’m lost for words. It’s just unbelievable that Yoochun as a citizen of a democratic country is supposed to depend on his fans who come to the court in their free time to protect his privacy from these b*stards?! I’d have taken photos of that dumb airhead reporter and posted them on the internet. Anyway, one thing is for sure – whoever plotted this nonsense about Chun, they were hoping fans would leave. I’m guessing we don’t miss the 3.5 “fans” who indeed left (they were never supportive in the first place). And the rest of us wish to protect our sunflower boy even more. We clearly see he needs it.

These so-called “reporters” could’ve eavesdrop;
get point A & point Z, and start filling up the blanks with their own stories/imaginations from B to Y;
and publish the whole damn combo as “facts” gathered from the court.
This is what they’ve been doing from Day 1.
They are unethical like that.

In my humble opinion, the evidences submitted by the witnesses here must be solid and truly valid;
so much so that they completely threw the defendants off the cliff.
Which should explain the Letters of Apology submitted to the court a week later,
by both Defendant Lee (the so-called “A”) and Defendant Hwang (the mob).
When they can’t cover their own stinky sh*t/lies no more;
when they know very well they’ve no way out, what do they do?
Yup. They submit their Letters of Apology to the court admitting to the crimes charged on them;
pretending remorse over their crimes;
hoping for the court to be lenient with their sentencing.
How convenient.
DEAR COURT,

The scale of punishments should correspond with the scale of crimes.
What these defendants are committing is murder.
CHARACTER ASSASSINATION IS MURDER. Murder is a SERIOUS CRIME.
They are murdering an innocent celebrity’s reputation without batting an eye.
To a celebrity >> Reputation=Life
They don’t deserve mercy from the court.
Do you know the extent of damages they’ve brought upon the victimized celebrity in this incident? All because of their greed?!
False accusation of sexual assault IS a serious crime.
Extortion IS a serious crime.
Only severe punishments can deter serious crimes.

As far as I remember, Yoochun never wrote any apologies. Obviously he did not have to! These defendants are funny people. They throw someone’s life into a trash can and hope it will not bring consequences. I’d make a poll and ask people – if they happened to be wrongly accused and scandalized to this extent in front of whole world – how would they punish the criminal gang? I bet not a single person would be willing to forgive such incident easily and most certainly they wouldn’t trade jail time for the offenders for some apology letter. In my opinion South Korea need to rethink their law and mindset, it’s not possible to fix grave crimes with apology. Sadly many people who commit wrongdoings or flatout crimes there use “remorse” as a cynical way to put additional pressure on the victim and create a situation where the victim is supposed to feel bad for seeking justice. Basically they show a sad face to the public and say “I’m so sorry and now what? Do you mean you want to punish me when I said sorry, you j*rks? For me it’s enough, so let me go home and you be happy I bowed in apology. You won’t get more than that.” Seriously, they act as if they were living in a TV drama. That needs to stop.
If you’ve been following recent political situation in SK, you know what I mean – if the president, prime minister, prosecutors, judges, chaebols, whoever powerful – breaks the law, they say “sorry” and basically get promoted or transferred to other high position. The insanely frustrating thing is there appear to be only a few ways to force punitive measures upon the offenders, in some cases they simply don’t come to testify because they don’t want to. How can a normal citizen expect justice for themselves and how can a person like Yoochun who is hated by a big company hope for justice in such environment? These “netizens” and other bullies hunting a wrongly accused celebrity should rather focus on finding the truth about Sewol. That would be a better way to spend their time.
